Roof Damaged By #Irma? Don’t Forget To Disclose

Q. My roof was damaged by Irma but it has already been fixed. Do I have to disclose this when I sell?

A. Yes, Florida’s disclosure laws are very clear. Sellers are obligated to disclose all known facts that materially and adversely affect the value of the property being sold which are not readily observable by the buyer. Some sellers think because they have repaired an issue that they can hide it from potential buyers. But ultimately failure to comply with Florida’s disclosure laws usually ends up in litigation. Think like a buyer and ask yourself this question – if you were buying your home, would you want to know about the roof?
